Terms of Service

1. Acceptance of Terms

By registering for or using PixelScale ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Description of Service

PixelScale provides an AI-assisted image upscaling service. Users upload images, which are processed server-side to increase resolution, and the resulting files are returned for download.

No images are stored. All uploaded files are processed in memory and immediately discarded after the upscaled result is returned to you. We do not retain any copies of your images.

3. Account Registration

• You must provide a valid email address and create a secure password.
• A valid invite code or Gumroad license key is required to register.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 13 years old to use the Service.
• One account per person. Creating multiple accounts to circumvent credit limits is prohibited.

4. Credits and Plans

The Service operates on a credit system. Each image upscale consumes 6 credits.

• Free plan: 60 credits, one-time, never refresh.
• Essential plan: 300 credits per month.
• Pro Creator plan: 900 credits per month.
• Unlimited plan: No credit limit.

Credits on paid plans reset monthly. Unused credits do not roll over to the next month. Credits have no cash value and are non-transferable.

5. Payments and Refunds

Plan upgrades purchased through Gumroad are subject to Gumroad's Terms of Service and refund policy.

Promo codes and invite codes are single-use, non-transferable, and have no cash value. They cannot be exchanged for a refund.

We reserve the right to change pricing at any time. Changes will not affect active paid subscriptions during their current billing period.

6. Acceptable Use

You agree not to use PixelScale to process images that:

• Are illegal in your jurisdiction or any other jurisdiction.
• Depict child sexual abuse material (CSAM) — strictly prohibited.
• Infringe the intellectual property rights of others.
• Are used for harassment, defamation, or targeted abuse of individuals.
• Contain malicious code or are used to exploit system vulnerabilities.

You also agree not to:

• Attempt to reverse-engineer, scrape, or abuse the Service's API.
• Share, sell, or transfer account credentials or promo codes.
• Use automated tools to process images in bulk beyond your plan's intended use.

7. Intellectual Property

You retain full ownership of images you upload and the upscaled outputs you download. By using the Service, you grant us a temporary, limited licence to process your images solely for the purpose of providing the upscaling service.

The PixelScale name, logo, and interface design are owned by us and may not be used without permission.

8. Privacy

We collect only the information necessary to operate the Service: your username, email address, and plan/credit information. We do not sell your personal data.

Images: Uploaded images are processed in memory and never written to disk or stored in any database. They are discarded immediately after processing.

Emails: Your email is used for account management (password resets, plan notifications, support replies) only. We do not send marketing emails without your consent.

9. Disclaimers and Limitation of Liability

The Service is provided "as is" without warranty of any kind, express or implied. We do not guarantee that the Service will be error-free, uninterrupted, or that upscaled images will meet your quality expectations.

To the maximum extent permitted by law, PixelScale shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including loss of data or profits.

10. Indemnification

You agree to indemnify, defend, and hold harmless PixelScale, its owner(s), developers, affiliates, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use or misuse of the Service.
• Your violation of these Terms of Service.
• Your violation of any applicable law, regulation, or third-party right.
• Any content or images you upload, process, or distribute using the Service.
• Any claim by a third party that your use of the Service caused harm to them.
• Any unauthorised use of your account credentials.

This indemnification obligation will survive termination of your account and these Terms.

In plain language: If you use this tool for something you shouldn't — illegal content, copyright infringement, harassment, or anything else prohibited — you are fully responsible for any consequences. The developers of PixelScale bear no liability whatsoever for how you choose to use the Service.

11. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms. You may delete your account at any time by contacting us via the Support page.

Upon termination, your credits are forfeited and are not refundable unless required by applicable law.
